Terms of Service

Welcome to Pikstage. These Terms of Service (“Terms”) govern your access to and use of the Pikstage website, applications, and services (collectively, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.

The Service is operated by Dev Patel (“we”, “our”, or “Pikstage”), a sole proprietor based in Vancouver, British Columbia, Canada.

1. Eligibility

You must be at least 16 years old, or the age of legal majority in your jurisdiction (whichever is greater), to use the Service. By using the Service, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You may close your account at any time from your dashboard settings. Closing your account permanently deletes your generated images, reference uploads, and personal data within 30 days, except where we are required to retain it by law.

3. The Service

Pikstage lets you upload reference product photos and generate AI-rendered variations of those products in different scenes. We use third-party machine learning models (including those operated by Replicate and Anthropic) to perform generation. The Service is provided on an “as-is” basis and we do not guarantee any specific output quality, style match, or commercial performance.

3.1 AI-generated content

All images generated through the Service are produced by AI models in response to your inputs. In line with the EU AI Act (Article 50) and comparable Canadian transparency principles, every generated image carries embedded metadata identifying it as AI-generated.

4. Your Content

You retain all ownership rights in the reference photos you upload. You grant Pikstage a worldwide, non-exclusive, royalty-free license to store, process, and transmit your reference photos solely for the purpose of providing the Service to you.

Subject to your full payment of applicable fees, you own the generated images we produce for you and may use them for personal or commercial purposes, including listing them on Shopify, Amazon, Instagram, and other platforms. You are responsible for ensuring the generated images comply with the requirements of the platforms you publish them to.

4.1 Acceptable use

You agree NOT to use the Service to:

  • Generate images of products you do not own or have permission to represent;
  • Generate content that infringes the intellectual property rights of third parties (including trademarks, copyrights, and brand assets you do not control);
  • Generate content that is illegal, defamatory, or harmful;
  • Generate sexual content, violent content, or content involving minors;
  • Reverse engineer the Service, scrape it, or attempt to extract our model prompts or system instructions;
  • Use the Service to compete with us by reselling generated images as a stock photo service;
  • Abuse our infrastructure (e.g., circumventing rate limits, sharing accounts, automated scripted scraping).

We may suspend or terminate accounts that violate this section without notice or refund.

5. Subscriptions and Billing

Paid plans renew automatically each month. Billing is handled by Stripe. By providing payment information, you authorize us (via Stripe) to charge your payment method on a recurring basis until you cancel.

You may cancel anytime from your Pikstage dashboard via the “Manage subscription” portal. Cancellation takes effect at the end of the current billing period; you keep access until then.

Refunds are governed by our Refund Policy.

6. Image Generation Quotas

Each plan includes a monthly image quota. Failed generations (e.g. provider errors, content-policy rejections) do not count against your quota. Unused images do not roll over month to month.

7. Third-Party Services

Pikstage relies on third-party providers to function:

  • Replicate — AI image generation
  • Anthropic — prompt enhancement
  • Supabase — database, authentication, and storage
  • Stripe — payment processing
  • Resend — transactional email delivery
  • Cloudflare — DNS and content delivery
  • Shopify — optional integration

We exchange the minimum data needed for each provider to perform its function (see our Privacy Policy).

8. Intellectual Property

The Pikstage name, logo, design, code, and all other materials we create are our intellectual property. Nothing in these Terms grants you any right to our intellectual property except as expressly stated.

9. Service Availability

We aim to keep the Service available 99% of the time. We do not guarantee uptime and the Service may be unavailable due to maintenance, third-party outages, or events beyond our control.

10. Disclaimers

The Service is provided “AS IS” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will meet your requirements, that generated images will produce any specific commercial result, or that the Service will be error-free.

11. Limitation of Liability

To the maximum extent permitted by law, Pikstage and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service.

Our total liability to you for any claim relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnity

You agree to indemnify and hold Pikstage harmless from any claims, damages, or expenses arising out of your use of the Service, your uploaded reference photos, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be brought exclusively in the courts of British Columbia.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Continued use after the effective date of any change constitutes your acceptance of the updated Terms.
